Terms of Service

These Terms & Conditions (rental terms) govern the rental of the holiday villa „Villa Oleander“ between Hildisch-Holan-Kerschbaumer GbR („Landlord“, „we“) and the tenant („you“).

1. Scope & contracting parties

The landlord is Hildisch-Holan-Kerschbaumer GbR, Donaustaufer Str. 13, 80993 Munich, Germany. These terms apply to all bookings of Villa Oleander – whether made directly with us or via a booking platform. For bookings via a platform (see section 3), the platform’s intermediation and cancellation terms additionally apply; in case of conflict, the platform’s terms prevail for the matter governed there.

2. Rental property

The property let is the house „Villa Oleander“ in the village of Kato Pines near Elounda, Crete, Greece, including all accessible living spaces, terraces, outdoor areas, pool and parking space. The exact location is indicated on the website. Protected areas – whether physical or electronic – may not be entered or used by guests.

3. Booking & conclusion of contract

Bookings can be made directly with us as well as via the following platforms:

  • Booking.com
  • Airbnb
  • Beds24 (direct booking engine)

The rental contract is concluded upon confirmation of the booking. By booking you accept these rental terms.

4. Rent & payment

The tenant pays the full rental price (less any down payment made) in good time before check-in via the offered electronic means of payment. Rental prices already agreed in binding bookings remain unchanged. Depending on the booking channel we accept common payment methods such as credit card, SEPA transfer and PayPal.

5. Deposit

The tenant pays the agreed deposit in good time before check-in (by credit card or PayPal) or in cash at check-in. It secures costs for a) damage to the property or furnishings, b) extraordinary soiling and/or waste removal, and c) other additional costs caused by the tenant or their guests. The deposit is refunded no later than 2 days after check-out, provided there are no complaints.

6. Maximum occupancy

The maximum number of guests is eight (8), including children. Over-occupancy is not permitted.

7. Rental period, check-in & check-out

The rental begins at the agreed check-in time, or at the latest upon handover of the keys, and ends at the agreed check-out time, or at the latest upon return of the keys.

8. Minimum rental period

The minimum rental period is 4 nights.

9. Tenant obligations & house rules

The equipment provided in living rooms, kitchen, bedrooms, bathrooms and outdoor areas must be treated with care. Resources provided such as water, electricity and internet are included in the rental price but should be used economically and with respect for the environment. Smoking is prohibited in all indoor rooms. The tenant allows the landlord or their representatives access to the property for cleaning, maintenance, inspection or in case of emergency; except in emergencies, access is announced at least 8 hours in advance.

10. Registration obligation (passport data)

The tenant is required by law to provide the passport data needed for reporting to the Greek authorities. This data is collected before arrival via our online check-in form; a copy of the passport is not required for this. Details on how this data is processed can be found in our privacy policy.

11. Tenant liability for damages

The tenant is liable for damage to the property and furnishings caused by them, as well as by other guests or third parties who were permitted to enter. Costs of remedying damage by repair or replacement will be charged to the tenant and may be offset against the deposit. Any damage must be reported to the landlord or on-site supervisor immediately.

12. Cancellation by the tenant

For direct bookings:

  • Cancellation up to 30 days before arrival: no cancellation fee (free cancellation).
  • Cancellation up to 7 days before arrival: 50% cancellation fee.
  • Cancellation within 6 days before arrival, as well as no-show: 100% cancellation fee.

For bookings via a platform (Booking.com, Airbnb, Beds24), the platform’s cancellation policy stated at the time of booking applies.

13. Extraordinary termination by the landlord

The landlord may terminate the rental prematurely and without notice if the tenant or their guests intentionally or grossly negligently violate these rental terms.

14. Landlord liability & force majeure

The landlord is liable without limitation for damage resulting from injury to life, body or health and for intent and gross negligence. Otherwise the landlord is liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. We accept no liability for events of force majeure (e.g. natural events, official orders).

15. Insurance

We recommend that all tenants have liability or travel insurance to cover any damage caused.

16. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision of these rental terms be invalid, the validity of the remaining provisions shall remain unaffected.
